TERMS

PAYMENT
A payment is agreed upon with you when trying on the dress, the deposit and terms of payment are also agreed upon. By accepting to hire the dress, you are entering into an agreement to be charged accordingly.
A deposit to hire the dress will be required before the dress is custom ordered or put on hold. The remainder of the rental price must be paid before secured for the event date.
A security bond per dress is charged when the remainder of the rental price is paid.
Dress Best reserves the right to take all steps necessary to recoup any amounts owing as per this agreement, including the use of debt collection agencies and taking legal action. This may increase the amount owed by the customer, to cover the costs of these services.
TITLE TO RENTAL ITEMS
All rental items remain the property of the rental partner or Dress Best Hire. At all times, the rental items are and remain the property of the rental partner. The dress may be retrieved at any time.
BOOKING PERIOD
The rental period includes your event date, the day before the event date and the day after. You have the day after the event date to return the item or a $25 charge is taken from the security deposit per day you are late. We do not need to remind you to return the dress, that is your responsibility to avoid a late charge. If you return your dress late, $25 will automatically be deducted for each day the dress is returned late from the security deposit.
The $25 late fee also applies to out-of-Sydney orders/shipped orders. If the dress has not been posted via express post and tracking is provided the day after the event, $25 will automatically be deducted for each day the dress is returned late from the security deposit.
INCORRECT OR FAULTY ITEMS
All items are checked before picked up or sent out via delivery or for pick up. We have the right to refuse a refund as items are checked thoroughly to eliminate requests for faulty items.
Items may have signs of wear and tear; this is not a basis to grand a refund.
ALTERATIONS
Alterations are provided with a partner alteration, these are charged additionally to the dress and quoted accordingly. You must not alter the dresses without our permission.
CUSTOM ORDER
If we have ordered a dress custom for you, and you are unhappy once it arrives, we do not offer a refund of the deposit or exchange. Custom orders are made according to what we have discussed. You cannot swap your custom order for another gown or use the deposit paid to pay for another dress.
Custom orders may differ from what is discussed in terms of colour, fabric, and styles, and this is not a basis for a refund or exchange. You accept this may occur.
Once the custom process has started, any cancellations cannot be made otherwise the deposit is lost. If the dress is not as discussed we cannot offer a refund of the deposit once the custom process has started.
An additional 0.5-1inch is added to the measurement taken unless advised, if the dress does not fit on arrival, this is not a basis for a refund. Measurements are taken accurately and change in your shape is not our liability. If the dress does not fit, we will do our best to alter the dress otherwise a new dress will need to be ordered. You are liable to pay the remaining balance on the original dress ordered.
The dress that has been custom ordered may be hired for events other than yours and before yours, we cannot keep the dress only for you to hire and signs of wear may occur on custom orders, this is not eligible for a refund or credit.
If the dress is delayed to arrive after the event date, you may cancel the order.
CANCELLATIONS
You may cancel a dress within the period after the first deposit is paid and before the remainder is paid. The deposit will not be refunded for any cancellations including COVID-19 reasons.
No exchanges or changing the dress once the deposit has been paid.
You will lose the deposit and will need to pay the full amount to book in a new dress. You may change the date of the hire if alterations have not been made to the dress and if the dress is available for the new date.
The following policy applies for cancellations and change of mind (no credit, exchange or refund on custom orders):
Same day as deposit is paid: A credit voucher for the full depsoit paid.
Day after deposit is paid - 4 weeks before the event date: A credit voucher for the full depsoit paid minus any alterations fees if alterations have been made, custom orders or add ons will not be included in the credit voucher.
Less than 4 weeks before the event date: 50% of the deposit paid credit voucher.
Less than 2 weeks before the event date or once picked up: No credit, exchanges or refunds for any amount.
The deposit is 50% of the total invoice. Applies till end of shop day, only to be used by initial recipient no family members and not transferrable.
RETURN OF ITEMS
The item must be returned in the bag or packaging provided when picked up, without damage otherwise fees apply including loss of security deposit. Any additional item such as a bag or clutch must be returned in original condition or $50 will be deducted from the security deposit.
Late Fees: You are liable to pay $25 for each day the dress is returned late. The dress is due the day after the event and in most cases a Monday. We will charge $25 for each day the dress is late excluding Sunday. If the dress is needed for another hire and returned late and we have to cancel the other hire, you are liable to pay the full hire fee of the cancelled hire. Late fees are deducted from the security bond or charged when the dress is dropped off. Failure to pay wil result in debt collection agency referrals.
We hold a security bond, when the dress is returned back we may hold onto the bond until we can make a better assessment if the bond can be returned or if the dress has been damaged. Security bond is not refundable if we believe the dress is damaged and requires attention including marks and stains.
CLEANING
You may not clean the rental item(s) yourself or have them cleaned by someone else as it may cause damage and we have the right to keep the full security deposit if this occurs.
DAMAGE OR LOSS
Damage includes stains, tanning marks, rips, etc. these are assessed when the dress is returned, if we need to repair minor damage such as a loose button, this will be taken care of at no charge. However, if any other damage is made to the dress including stains, the full security deposit will be kept by us to fix the damages.
If the dress has diamonds and these are damaged or fallen off, we will charge between $50-$200 depending on the damage caused and diamonds that have fallen off.
If the item is lost, you will not receive your security deposit, regardless of who is to blame. Plus, an additional amount may be payable to accommodate for the cost of the dress.
We hold a security bond, when the dress is returned back we may hold onto the bond until we can make a better assessment if the bond can be returned or if the dress has been damaged.
THEFT
If you fail to return the dress the day after the event and we have made an effort to contact you, you are liable to pay the full-dress retail price. This is considered theft and authorities will be notified.
LIMITATION OF LIABILITY
By proceeding with the hire, you accept the rental agreement and that Dress Best Hire and all rental partners are not liable for any loss, damage, costs incurred by any conditions.
COVID-19 POLICY
If an event is rescheduled or cancelled due to the COVID-19 lockdown, you are eligible for a credit note only for the amount paid. No refunds. Credit note is valid for 12 months and can only be used by the original hire recipient. Credit cannot be used to pay other hire balances, only valid on a new hire.
CHANGES TO THE RENTAL AGREEMENT
We reserve the right to change the rental agreement at any time including cancelling your hire and no reimbursement other than a refund of the fee paid will be made to you.
This agreement and it’s terms still applies to any changes to the dress or item hired.
DELIVERY TERMS
If the dress is being tried on via our Try-On Service or booked via delivery, all terms and conditions including late fees apply.
There are no refunds or exchanges if the dress does not fit you or you are unhappy with the quality, fit, etc. The dress may look different to as advertised, this does not warrant a refund or exchange as photos and/or videos are sent to the recipient before delivery. The dress may be altered locally at your own cost and with our approval first.
